1. Acceptance of these Terms

By downloading, installing, accessing or using the Services, you agree to these Terms and to our Privacy Policy and Refund & Cancellation Policy. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old and capable of entering a binding contract under Indian law to use the Services. If you are younger, you may use them only with the involvement and consent of a parent or legal guardian, where permitted by law.

3. Your account

• You must give accurate information and keep it up to date.
• You are responsible for all activity under your account and for keeping your login details and OTPs confidential.
• Tell us immediately if you suspect unauthorised use of your account.

4. The Services

SamayReels offers vertical short-drama entertainment. Content, features and availability may change, and some content or features may be limited to certain regions, devices or app versions. We may add, change or remove content and features at any time.

5. Paid features and payments

• Some features may be paid, for example coins or credits, episode unlocks or subscriptions (“Paid Features”). Prices are shown in Indian Rupees (INR) before you pay and include applicable taxes unless stated otherwise.
• Payments are processed by third-party payment partners such as Razorpay or by Google Play. Their terms also apply to your payment.
• Subscriptions, if offered, renew automatically at the end of each period until cancelled, as described in our Refund & Cancellation Policy.
• Coins, credits and unlocks have no cash value, cannot be transferred or exchanged for money, and may expire as shown in the app.
• If a payment fails, we may limit access to Paid Features until it is resolved.

6. Licence to use the Services

We give you a limited, personal, non-exclusive, non-transferable, revocable licence to use the app and watch content for your personal, non-commercial entertainment. All rights not expressly given are reserved.

7. Acceptable use

You agree not to:

• copy, record, download (except through features we provide), redistribute, publicly perform or sell any content;
• bypass or interfere with security, access limits, digital rights management or payment systems;
• reverse engineer, scrape, or use bots or automated means to access the Services;
• share your account, or use another person's account or payment method without permission;
• upload or send anything unlawful, harmful, infringing, obscene or misleading, or that exploits or endangers children;
• abuse promotions, refunds or referrals, or commit fraud.

8. Intellectual property

The Services, including the SamayReels and SIMKA ENTERTAINMENT names, logos, app design, software, dramas, artwork, music and text, are owned by SIMKA ENTERTAINMENT PRIVATE LIMITED or its licensors and are protected by Indian and international intellectual property laws. Nothing in these Terms transfers any ownership to you.

Concept artwork and illustrative titles shown on our website are examples of our storytelling vision and do not represent released series.

9. Feedback

If you send us ideas or suggestions, you allow us to use them without payment or obligation to you.

10. Third-party services

The Services may rely on or link to third-party services such as app stores and payment providers. We are not responsible for their content, availability or practices.

11. Availability and changes

We try to keep the Services available but do not promise they will be uninterrupted or error-free. We may suspend or modify the Services for maintenance, security or reasons beyond our control. We may update these Terms; the updated version applies from the date posted, and continued use means you accept it.

12. Suspension and termination

You may stop using the Services or delete your account at any time (see Delete Account). We may suspend or end your access if you break these Terms, misuse the Services, or if required by law. Sections that by nature should continue, such as intellectual property, disclaimers, liability and governing law, will survive.

13. Disclaimer

The Services are provided “as is” and “as available”. To the extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. Content is fictional entertainment and does not constitute advice.

14. Limitation of liability

To the extent permitted by law, SIMKA ENTERTAINMENT PRIVATE LIMITED and its directors, employees and partners are not liable for indirect, incidental, special or consequential loss. Our total liability for any claim relating to the Services is limited to the amount you paid us for the Services in the three months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law.

15. Indemnity

You agree to compensate us for losses, claims and costs arising from your breach of these Terms or misuse of the Services.

16. Copyright and takedown

If you believe content on the Services infringes your copyright, send us the details at ceo.simka@gmail.com: your contact information, a description of the work, where the content appears, and a statement that you are authorised to complain. We will review it and act as the law requires.

17. Grievance redressal

For complaints about the Services, please use our Grievance Redressal process.

18. Governing law and disputes

These Terms are governed by the laws of India. Subject to any rights you have under consumer protection law, courts at Guwahati, Assam have exclusive jurisdiction. We encourage you to contact us first so we can try to resolve any concern informally.

19. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver. You may not transfer your rights under these Terms; we may transfer ours as part of a business change. These Terms, with the policies linked in them, are the entire agreement between you and us about the Services.
